WILLS, TRUSTS, & POWERS OF ATTORNEY - DOCUMENT SUPPORT

We assist clients with compiling and organizing the information needed for the preparation of wills, trusts, and powers of attorney. Because these documents may be filed with the courts, we also refer clients to a qualified legal team to ensure the language and documentation are accurate and properly prepared prior to submission.

Preparing these documents is not always an easy task. Many people associate wills and trusts with end-of-life planning, which can feel uncomfortable to address. According to an AARP survey, two out of five Americans over the age of 45 do not have a will or trust.

However, creating these documents is one of the most important steps you can take to protect your loved ones. Clearly documenting your wishes helps reduce confusion, avoid unnecessary delays, and provide peace of mind knowing your affairs will be handled according to your intentions. Proper planning can also save your family time, stress, and unnecessary expenses.

Because laws governing wills and trusts vary by state, clients are encouraged to consult with a licensed attorney or estate planning professional to ensure compliance with applicable legal requirements.

A living will allows you to document your wishes regarding medical treatment in the event you become unable to communicate them yourself. This may include situations involving terminal illness, severe injury, or irreversible medical conditions.

A living will can outline preferences such as:

  • Whether you wish to receive life-sustaining treatments

  • Use of ventilators or resuscitation measures

  • Preferences for palliative care

  • Organ donation decisions

By documenting these wishes in advance, you provide guidance to your loved ones and healthcare providers during critical moments.

WHAT IS A LIVING WILL?

WHAT IS A LIVING TRUST?

A living trust is a legal document created during your lifetime that outlines how your assets, dependents, and affairs should be managed. Unlike a will, which takes effect only after death and typically goes through probate, a living trust can take effect during your lifetime and may help avoid the probate process altogether.

A living trust allows a successor trustee to manage your affairs:

  • After your death

  • Or if you become unable to manage your financial, healthcare, or legal matters due to incapacity

This can provide continuity, privacy, and efficiency in managing your estate.
